1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and MVA Click (“MVA Click,” “we,” “us,” or “our”) regarding your access to and use of the website located at mvaclick.com and all related tools, questionnaires, features, and case intake services (collectively, the “Services”).

By accessing or utilizing mvaclick.com, or submitting information through our web intake forms, you signify that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy. If you do not agree, you must cease using the Services immediately.

2. Legal Advertising & Information Services Only (Not a Law Firm)

MVA CLICK IS NOT A LAW FIRM, ATTORNEY REFERRAL SERVICE, OR LEGAL AID SOCIETY.

• MVA Click does not practice law, does not offer legal advice, and does not represent individuals in judicial, administrative, or arbitration proceedings.
• The materials, content, case valuations, timelines, and guides published on mvaclick.com are prepared for general educational, consumer informational, and legal advertising purposes only.
• Nothing on this site should be construed as legal counsel, judicial advocacy, or a substitute for professional legal guidance from a licensed personal injury attorney admitted to the bar in your state.
• Participating law firms pay an advertising and administrative fee to MVA Click for marketing services and intake lead distribution.

3. No Attorney-Client Relationship Created

Visiting mvaclick.com, reviewing informational articles, sending emails, or completing our case consultation intake form does NOT form an attorney-client relationship between you and MVA Click, nor between you and any affiliated law firm.

An attorney-client relationship is established solely when you and an independent licensed attorney execute a formal written retainer agreement specifying the scope of legal representation, attorney fee arrangements, and client responsibilities.

4. User Representations & Eligibility

By using mvaclick.com and submitting an accident inquiry, you affirmatively represent and warrant that:

• You are at least 18 years of age and possess full legal capacity to enter into binding agreements.
• All information you provide regarding your identity, contact telephone, email address, accident date, and injury details is truthful, accurate, and current.
• You are submitting an inquiry concerning an accident in which you or an immediate family member for whom you hold legal authority was directly involved.
• You are not using the Services for fraudulent purposes, automated data scraping, commercial spam, or malicious interference with our systems.

5. TCPA Consent & Telecommunication Terms

By submitting your telephone number on our intake form and clicking “Get My Free Consultation,” you expressly authorize MVA Click and its partner law firms to contact you via live phone call, SMS/MMS text messages, and automated calling technology (including autodialers and prerecorded messages) regarding your case inquiry, even if your number is listed on a National or State Do Not Call registry. Consent is not a condition of purchasing services. Message and data rates may apply. You may opt out at any time by replying STOP to any text message or emailing hello@mvaclick.com.

6. Independent Law Firm Retainers & Contingency Fees

Any legal representation agreed upon following an initial consultation is governed exclusively by the separate written retainer agreement between you and the independent law firm. Most personal injury attorneys represent clients on a contingency fee basis, where legal fees are paid as an agreed percentage of the financial recovery obtained. MVA Click is not a party to any retainer agreement and does not receive a share of legal fees awarded in litigation.

7. Disclaimer of Warranties

THE SERVICES AND ALL INFORMATION ON MVACLICK.COM ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. MVA CLICK EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MVA CLICK, ITS DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF MVACLICK.COM OR ANY INTERACTIONS WITH INDEPENDENT LAW FIRMS. IN NO CASE SHALL OUR AGGREGATE LIABILITY EXCEED ONE HUNDRED DOLLARS ($100.00 USD).

9. Mandatory Binding Arbitration & Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be resolved exclusively through final and binding confidential arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. YOU WAIVE THE RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST MVA CLICK.

10. Governing Law

These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without giving effect to conflict of law principles.
